Below we have listed important legal terms that apply to anyone who visits our website or uses our services. These terms are necessary in order to protect both you and us, and to make our services possible and more enjoyable for everyone. A Heart for Marietta's Website offers a wide range of services and features and, as a result, part of the terms below many not be relevant to the specific services that you may use or engage with.

1. Introduction​
​​1.1​ Our Purpose​

A Heart for Marietta's Website is a platform that serves as an extension of our ministry. It allows us to plan/schedule, promote, communicate, and bring the community together through various events, activities, and to build social connections. The website's associated services also generate electronic passes / tickets which can be utilized with most modern smartphones for ease of checking-in to these events. By accessing and using this website, you agree to comply with and be bound by the following Terms of Use. If you do not agree with any part of these terms, please refrain from using our website. Please review the following carefully.

All visitors or users ("User" or "you") may peruse and interact with our website and may also obtain tickets to any of our upcoming events, as well as purchase merchandise and any other offerings from our online e-commerce storefront (when available).

Visitors who register for a Membership account may signup (and are encouraged to do so) via RSVP to volunteer at select events which will be communicated out in advance of the events.

Membership enables these users to access areas of the website that the general public is not allowed to access.

Membership requires a normal signup procedure which includes providing the user's complete and accurate contact information.

Members are able to provide personal testimonials and add / upload social media content related to each respective event in which they have served as a volunteer.

Members are able to interact with other members via the site's social media capabilities within their respective group(s) and events.

All social media content is reviewed by our staff before it is ever published and goes live.

We reserve the right to selectively promote some of the social media content to the public facing site where all visitors may see it, such as pictures, videos, and text for the purpose of testimonials and general marketing.

If any member posts content that is counter to the goals of this ministry or is deemed inappropriate in any way, at our sole discretion, such content will be removed and the corresponding member's account will be revoked.

1.2​ Legal Agreement​
These Terms of Use ("Terms of Use"), together with such additional terms which specifically apply to some of the services and features as presented on the aheartformarietta.org website ("AHFM Website") and any other related services, collectively - the "AHFM Terms"), set forth the entire terms and conditions applicable to each visitor or user of the AHFM Website and/or any other services, applications and features offered by us with respect thereto, except where we explicitly state otherwise (collectively - the "AHFM Services" or "Services").

You may visit and/or use the AHFM Website and associated Services only if you fully agree to the AHFM Terms - and by using and/or registering to any of the AHFM Services, you signify and affirm your informed consent to these Terms of Use and any other AHFM Terms applicable to your use of any AHFM Services. If you do not read, or fully understand or if you do not agree with the AHFM Terms, you must immediately leave the AHFM Website and avoid or discontinue all use of the AHFM Services.

By using our Services, you also acknowledge that you have read our Privacy Policy available at Privacy Policy.

The AHFM Website and the electronic services that it provides utilize the products and services of Wix.com and other vendors who partner with and/or sell their services via Wix.com. All of their associated products and services are respectively owned by Wix.com and other vendors and they each retain all rights to their respective products and/or services. Wix.com and other vendors each have their own respective legal agreements pertaining to the use of their products and services.

1.3​ User Access and Accounts
​
The AHFM Website is available and accessible (generally) to all visitors who have access to the internet and a modern web browser. For the normal/typical website visitor, there are no required AHFM accounts and/or login credentials required for such use. There is, however, a AHFM Member/Membership account which is utilized for the purposes of enrolling and managing event volunteers and for capturing social media content. For those who create a Member account, you must provide accurate and complete information when registering for your Membership Account. These individuals are also expected to participate as volunteers for one or more of the AHFM Events. There are also (internal) staff accounts which are associated with different roles and permissions within the AHFM Platform.

1.4​ Event Tickets and RSVPs
​​
The AHFM Website allows all visitors to purchase/reserve/obtain electronic tickets purchased through our website for attendance at a specific event. All such tickets are non-refundable unless otherwise specified. The AHFM Website also allows for Members to obtain an RSVP to these same events. For AHFM operations, the main difference between an electronic ticket and an RSVP is that tickets are for guests for the events and RSVPs are those who will serve as volunteers at the respective event. This distinction allows us to better manage our planning efforts. Note that all event registrations are subject to availability and may require confirmation from our team.

1.5​ Signup for Communications and Partner Recommendations

The AHFM Website allows all visitors to submit their email address to join our email distribution for all things that are newsworthy related to AHFM. We also offer the Connect with Us form which allows you to provide your contact information and any Host Recommendations. Recommendations for potential hosts and/or partners are subject to our internal vetting and approval. All such recommendations are greatly appreciated and help us to build a stronger and more networked community!

2. Your Obligations​
​​2.1​ You represent and warrant that:​

you are at least thirteen (13) years of age and possess the legal authority, right and freedom to enter into the AHFM Terms and to form a binding agreement, for yourself or on behalf of the person or entity committed by you to the AHFM Terms;

you are not ordinarily a resident of, and will not use or distribute the AHFM Services, any country or region subject to U.S. comprehensive country or regional embargo. You further confirm that you are not included on any sanctions list, including without limitations, the U.S. Specially Designated Nationals and Blocked Persons List, maintained by the U.S. ("SDN List"), or any other applicable sanctions list maintained by the EU, the UK or other, and that you are not owned 50 percent or more, directly or indirectly in the aggregate, by a Sanctioned Party and are not otherwise controlled by such a party ("Sanctioned Party"). You agree to indemnify AHFM against any and all losses, including without limitations, monetary penalties and legal fees, that AHFM may suffer should you violate any of the forgoing confirmations regarding your non-sanctioned status.

your country of residence and/or your company's country of incorporation is the same as the country specified in the contact and/or billing address you provide to us;

you understand that AHFM does not provide any legal advice or any recommendation with respect to any laws or requirements applicable to your use of the System;
And specifically regarding your User Content: -
you confirm that you own all rights in and to any content to which you upload, import, and/or copy to the AHFM Website, including any designs, images, animations, videos, audio files, fonts, logos, illustrations, compositions, artworks, usernames, or otherwise have (and will continue to have) the full power, title, licenses, consents and authority, in and to the User Content as necessary to legally access, import, copy, use, connect, publish, transfer or license such User Content, by you;

the User Content is (and will continue to be) true, current, accurate, non-harmful, non-infringing upon any third party rights, and in no way unlawful for you to upload, import, export, copy, possess, post, publish, transmit, display or otherwise use, and/or for other End Users to access, import, export, copy, upload, publish, post, store, use or possess in connection with the AHFM Services;

you have obtained all consents and permissions required under all applicable laws, regarding the processing, storing, collection, posting, transmission and publication of any personal information and/or image or likeness of any person, entity or property which is considered as or for the purposes of User Content;

you will comply with the AHFM Codes of Conduct, which outline the permissible and prohibited Content on our Service;

you agree that AHFM may choose to reuse your Content on our Service for the purpose of promoting our Services.

2.2​ You undertake and agree to:​

regularly and independently monitor any of your User Content and information that is being processed by you;

allow AHFM to use in perpetuity, worldwide and free of charge, reuse of your User Content for any of AHFM's marketing and promotional activities, online and /or offline, and allow us to modify it as reasonably required for such purposes, and you waive any claims against AHFM or anyone on its behalf relating to any past, present or future moral rights, artists' rights, or any other similar rights worldwide;

AHFM's sole discretion as to the means, manner and method for performing the AHFM's Services, including the changing of structure and method/s of functionality;

AHFM shall have the right to offer the AHFM Services in alternative arrangements of accounts, structure, presentation, functionality, and pricing.

2.3​ You agree and undertake not to:​

copy, modify, create derivative works of, download, adapt, reverse engineer, emulate, migrate to another service, translate, compile, decompile or disassemble the AHFM Website, the Services (or any part thereof), any Content within our User Platforms and/or any part thereof in any way, or publicly display, perform, transmit or distribute any of the foregoing without AHFM's prior written and specific consent;

use any illegal action to collect login data and/or passwords for other any AHFM Users and/or AHFM System;

act in a manner which might be perceived as damaging to AHFM's reputation and goodwill or which may bring AHFM into disrepute or harm;

purchase search engine or other pay per click keywords (such as Google AdWords), or domain names that use "A Heart for Marietta" or AHFM Marks and/or variations and misspellings thereof;

reverse look-up, trace, or seek to trace another User of AHFM Services, or otherwise interfere with or violate any other User's right to privacy or other rights, or harvest or collect personally identifiable information about visitors or users of the AHFM Services and/or User Platform;

disable, circumvent, bypass or otherwise avoid any measures used to prevent or restrict access to the AHFM Services, User Platform, the account of another User(s), or any other systems or networks connected to the AHFM Services, by hacking, password mining, or other illegitimate or prohibited means;

probe, scan, or test the vulnerability of the AHFM Services or any network connected to the AHFM Services;

take any action that imposes an unreasonable or disproportionately large load on the infrastructure of the AHFM Services or systems or networks connected to the AHFM Services, or otherwise interfere with or disrupt the operation of any of the AHFM Services;

use the AHFM Services and/or User Platform in connection with any form of spam, unsolicited mail, fraud, scam, phishing, "chain letters", "pyramid schemes", or similar conduct, or otherwise engage in unethical marketing or advertising;

violate, attempt to violate, or otherwise fail to comply with any of the AHFM Terms or any laws or requirements applicable to your use of the AHFM Services.
You acknowledge and agree that your failure to abide by any of the foregoing or any misrepresentation made by you herein may result in the immediate termination of your User Account and/or any Services provided to you - with or without further notice to you, and without any refund of amounts paid on account of any such Services.

Among others, you may not copy our materials, use any content in an illegal or harmful manner, use our services or content on any platform or website not provided by us, make any misrepresentations or abuse our Services, or otherwise violate anyone's rights or any applicable laws.

AHFM reserves the right to modify these Terms of Use at any time. Continued use of the website after changes are made constitutes acceptance of the updated terms.
